The Defendant
eviCore Healthcare MSI, LLC provides healthcare management services with locations in several states throughout the country.
The Employees
Non-exempt clinical or non-clinical customer service representatives, physician support representatives, and/or consumer engagement representatives, who were (1) primarily responsible for taking or making inbound or outbound calls, (2) assigned to work for one of Defendant’s call centers in Colorado, Connecticut, Florida, Missouri, New York, South Carolina, and Tennessee (collectively “Call Center Employees”), and (3) worked overtime during the period of December 13, 2016 – September 30, 2020 (excluding weeks worked in Department 1480).
The Claims in the Lawsuit
The lawsuit claims that eviCore failed to pay the Call Center Employees for all of their hours of work and failed to pay them overtime compensation at the proper rate, in violation of the Fair Labor Standards Act (“FLSA”) and the Missouri Minimum Wage Law (“MMWL”)
Case Status
December 13, 2019: The complaint was filed in the United States District Court for the Eastern District of Missouri and has been assigned to Judge Ronnie L. White.
November 12, 2020: a notice of the settlement was sent to all non-exempt clinical or non-clinical customer service representatives, physician support representatives, and/or consumer engagement representatives, who were (1) primarily responsible for taking or making inbound or outbound calls, (2) assigned to work for one of Defendant’s call centers in Colorado, Connecticut, Florida, Missouri, New York, South Carolina, and Tennessee (collectively “Call Center Employees”), and (3) worked overtime during the period of December 13, 2016 – September 30, 2020 (excluding weeks worked in Department 1480). Eligible employees may participate in the settlement by submitting a claim form by December 27, 2020.
