The lawsuit alleges that Defendant restricted employees from clocking in before approximately 7:40 a.m. while requiring them to attend a mandatory 7:50 a.m. huddle, leaving insufficient paid time to complete required opening work. It further alleges that Defendant knew or should have known that employees performed this work before clocking in and benefited from having its clinics ready to serve patients on time.
Second, the complaint alleges that Defendant calculated overtime using employees’ base hourly rates while excluding nondiscretionary compensation from the regular rate of pay. The additional compensation allegedly included “Perfect At” or Perfect Attendance payments, “Scheduling” payments, and similar payments earned for satisfying attendance, scheduling, shift-pickup, or other work-related conditions.
The named Plaintiff’s pay records allegedly show overtime paid at exactly one and one-half times her base hourly rate even during pay periods in which the Plaintiff received Perfect Attendance, Scheduling, or similar additional compensation. The lawsuit alleges that Defendant therefore failed to pay the additional overtime premiums attributable to those payments.
Arizona Wage Claims
For Arizona employees, the lawsuit alleges that Defendant violated the Arizona Wage Act by failing to pay all wages due for labor and services performed.
The complaint alleges that Defendant failed to pay Arizona employees for pre-shift opening, clinic-preparation, equipment, meeting-related, and other off-the-clock work. It also alleges that Defendant failed to pay all wages due when it excluded Perfect Attendance, Scheduling, and similar nondiscretionary payments from employees’ overtime regular-rate calculations.
The lawsuit seeks unpaid wages and treble damages where available under Arizona law.
