The complaint alleges that MXR Imaging did not pay field service engineers overtime compensation at one and one-half times their regular rates of pay for all hours worked over forty (40) in a workweek. The complaint further alleges that MXR Imaging sometimes paid additional amounts labeled as after-hours pay or overtime pay-period compensation, but that these payments did not reflect all overtime premiums allegedly required by law.

The lawsuit brings federal claims under the Fair Labor Standards Act (“FLSA”) on behalf of salaried field service engineers employed by MXR Imaging in the United States.

State Wage Claims

The lawsuit also brings state-law overtime claims on behalf of field service engineers who performed work in Michigan, Pennsylvania, Maryland, Virginia, Massachusetts, New Jersey, New York, Connecticut, Illinois, and Kentucky.

The complaint alleges that MXR Imaging violated the overtime laws of those states by failing to pay salaried field service engineers one and one-half (1.5) times their regular rates of pay for all hours worked over forty (40) in a workweek.

The lawsuit seeks unpaid overtime wages, liquidated damages, statutory damages where available, penalties or enhanced damages where available, pre- and post-judgment interest, attorneys’ fees, costs, and other relief permitted by law.

Former employees may still be eligible if they worked during these periods.

For the federal law claims, workers can generally recover wages for up to two years before the date they join the lawsuit by filing a signed consent form with the Court, or for up to three years if the Court finds that MXR Imaging’s alleged violations were willful under the FLSA. The complaint alleges willful FLSA violations.

Case Status

June 17, 2026: The lawsuit was filed in the United States District Court for the Eastern District of Pennsylvania.

No court has ruled on the merits of the claims, and no class or collective action has been certified.
