I had the honor of serving in the Federal Bureau of Investigation during one of our country’s most challenging periods. I worked non-stop as a Special Agent and Legal Advisor handling some of the highest profile cases of that time, such as the 9/11 hijacking, the 2001 anthrax attacks, and the Daniel Pearl kidnapping and murder, as well as running and participating in undercover activities and handling other very high-level matters in which the United States was a party. I worked alongside many honorable individuals who were willing to sacrifice their lives for the country, and some who unfortunately did (peace to my buddies KM and BB). I left the Bureau in 2005 and now practice in the private sector.

The FBI is the premier law enforcement agency in the world and when I was part of it, I did not perceive any slant towards any political party. And now as a qui tam attorney in the private sector, I frequently interact with attorneys from the Department of Justice and with other FBI Special Agents, and the individuals I encounter are professional, apolitical,, and dedicated to their mission to work hard to combat fraud against the taxpayers – something that we can all agree should be stopped.

Any successful False Claims Act prosecution requires working with the DOJ, which I have seamlessly done for decades to protect the taxpayers. It is a great honor to work on behalf of whistleblowers who step forward to report systemic fraud upon the government. Through their courage and integrity, the system is ultimately improved, saving taxpayer money and sometimes saving lives. In cooperation with outstanding individuals in the DOJ and the Bureau, our firm has obtained settlements and judgments against fraudsters for hundreds of millions of dollars (in the aggregate). We’re proud that we’ve helped restore funds that were cheated from the taxpayer through Medicare/Medicaid fraud, kickbacks, pharmaceutical fraud, defense contractor fraud, and other fraud upon the government. There’s nothing political about that work.

But the Bureau is also charged with investigating internal corruption in the government itself, and anytime either political party is investigated there are bound to be accusations of partisanship. It is no different today. Serious allegations of partisanship and attempts to censor have been levied against the Bureau in recent years. I am a big advocate of the First Amendment and would denounce any attempt by the FBI or any government agency to stifle lawful speech, even abhorrent speech that I disagree with.

I fully support independent and thorough investigations to restore the public’s confidence in the Bureau and to implement change where needed. Every government agency should be held accountable, including the Bureau. However, let’s remember that even if some bad actors are found, they do not represent the Bureau as a whole, and their actions shouldn’t be allowed to tarnish the work and dedication of the vast majority of agents and other DOJ officials and employees.
